Emir Iskandar Hanafiah is a student and he works as a e-hailing rider during his free time. He has been doing the e-hailing delivery for 2 years now and very recent, the e-hailing company was having a bad business and decided to decrease the delivery allowance of all riders from RM8 per 1 KM to RM7 per 1 KM, taking an immediate effect. Due to the situation, Emir is confused of his employment and contract statues to enable him to take action against the company. Based on the situation, advise Emir and analyze the types of his contract. (15 marks)
Louisa is a senior manager at Rubina Works & Engineering Sdn Bhd. She has been serving the company for almost 6 years now. Throughout her years of employment, she was fully in charge of giving out and approving tenders for private companies and government agencies. Recently, the company undergone an audit process and it was discovered by the auditors that there are more than 50 projects were awarded to 3 similar companies which shown Louisa as one of the partner. It was also exposed that Louisa accumulates 45% from the total tender sums and was paid RM850,000 - RM1 million for each tender by the potential company. After due inquiry and investigation conducted against Louisa, it was proven that she was involved in a financial fraud of bribery and misconduct. The company decided to terminate Louisa but hesitates to do as she was a senior employee and permanent worker with the company. Based on this situation, examine whether Louisa may be terminated.
